Terms of Service

These terms are a contract between you and Rob Mardall ("Summit", "we", "us") covering your use of the Summit mobile app and any related services. By installing or using Summit, you agree to them. If you don't, please don't use the app.
1. Using Summit
Summit is a personal coaching app that uses an AI model to generate suggested daily steps toward a goal you describe. You must be at least 13 years old (or 16 in the EEA) to use Summit, and old enough to enter a binding contract where you live.
2. Your account
You sign in with an Apple or Google account. You're responsible for keeping that account secure and for activity that happens under your Summit account. Let us know at rmardall@gmail.com if you notice anything you didn't do.
3. Subscriptions and billing
Summit offers an auto-renewing subscription that gives you ongoing access to coaching features. The current price is shown in the app before you confirm.
- Payment is charged to your Apple ID or Google account at confirmation of purchase.
- Your subscription renews automatically at the end of each billing period unless you cancel at least 24 hours before the end of the current period.
- Your account is charged for renewal within 24 hours before the current period ends, at the displayed price.
- You can manage or cancel your subscription in your device's App Store or Google Play account settings. We can't cancel it for you - that's controlled by Apple and Google.
- Refunds are handled by Apple (reportaproblem.apple.com) and Google (Play refund help), not by us.
4. Free trials
If a free trial is offered, you must cancel at least 24 hours before the trial ends to avoid being charged. Any unused portion of a trial is forfeited if you purchase a subscription before the trial ends.
5. What you put into Summit
You keep ownership of the goals, reflections, and check-ins you put into Summit. By using the app you grant us a limited licence to process that information so the app can do its job - for example, sending it to our AI model so the coach can generate your next step. We don't sell or publish your content, and we don't use it to train AI models.
6. Not professional advice
Summit is a self-improvement tool, not a substitute for medical, mental health, legal, financial, or professional advice. Suggestions generated by the AI coach are exactly that - suggestions. If your goal touches on your health, finances, or anything that warrants professional input, please get it. Don't rely on Summit alone for decisions that meaningfully affect your life.
7. Acceptable use
Please don't use Summit to:
- Break the law or harm anyone, including yourself
- Reverse-engineer, scrape, or abuse the API or our infrastructure
- Attempt to extract the model's weights, system prompts, or generate content that violates our AI provider's usage policies
- Resell or sublicense Summit or its outputs as a competing service
We can suspend or terminate accounts that abuse the service.
8. Our intellectual property
The Summit name, logo, app design, copy, and software belong to us. You get a personal, non-transferable, revocable licence to use the app while these terms are in force.
9. Disclaimers
Summit is provided "as is". We don't promise it'll be available without interruption, that suggestions will be perfectly suited to you, or that you'll reach your goal - that part is up to you. To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the extent permitted by law, our total liability arising out of or related to Summit is limited to the greater of (a) the amount you paid us in the twelve months before the claim, or (b) US$50. We're not liable for indirect, incidental, consequential, or punitive damages, or for lost profits or data, even if we knew they were possible. Some jurisdictions don't allow these limits - in which case they apply only to the extent permitted.
11. Termination
You can stop using Summit at any time by deleting the app and cancelling any active subscription through the App Store or Google Play. We can suspend or terminate your access if you break these terms. Sections that by their nature should survive termination - including disclaimers, liability limits, and governing law - will continue to apply.
12. Changes to these terms
We may update these terms occasionally. If changes are material, we'll notify you in the app or by email and update the date at the top of this page. Continuing to use Summit after a change means you accept it.
13. Governing law
These terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules. Disputes will be heard by the courts of England and Wales, except where applicable consumer law gives you the right to bring a claim where you live - in which case that right is preserved.
